Understanding the Two-Tier Contingency Fee

The “20% is plenty” claim refers to the attorney’s pre-suit contingency fee. The firms in this directory have agreed in writing to the following two-tier fee structure on personal injury matters:

• 20% attorney’s contingency fee if your case is resolved before a lawsuit is filed.
• 35% attorney’s contingency fee if a lawsuit must be filed to pursue your recovery. The higher rate reflects the substantial additional work required to litigate a case in court.

These percentages refer strictly to the attorney’s contingency fee (i.e., the portion of the settlement or verdict the firm retains for their time and services). They do not include case costs and expenses.

In almost all personal injury cases, costs are incurred to pursue the claim, such as court filing fees, expert witness fees, court reporter fees, medical records retrieval costs, and investigator fees. Depending on the specific written agreement you sign with your lawyer, these costs are typically deducted from your portion of the recovery in addition to the attorney’s contingency fee. The decision to file a lawsuit is made by you and your attorney based on the specific facts of your case.
